Successful Outcome for Client Facing Driving Charge

Our criminal law solicitor, Samuel Oakley, recently appeared before Gosford Local Court for a client charged with driving while their licence was cancelled.

The offence carries a maximum penalty of 6 months imprisonment or a fine of $3,300 or both. There is also an automatic licence disqualification of 6 months upon conviction.

Mr Oakley successfully argued that our client should be sentenced pursuant to section 10(1)(a) of the Crimes (Sentencing Procedure) Act 1999. Accordingly, the charge was dismissed and no conviction was recorded. Further, because a conviction was avoided, he did not lose his licence.
